Terms of Service

Please read these Terms carefully. They govern your access to and use of Pebble Log.
1. Acceptance of these Terms
These Terms of Service (the "Terms") are a binding agreement between you and Pebble Log ("Pebble Log," "Pebble," "we," "us," or "our") and govern your access to and use of the Pebble Log website, applications, and related services (collectively, the "Service"). By accessing or using the Service, creating an account, or clicking to accept these Terms, you agree to be bound by them and by our Privacy Policy, which is incorporated here by reference. If you do not agree, do not use the Service.
2. Eligibility and age
You must be at least 13 years old to use the Service, and you may use it only if you can form a legally binding contract with us and are not barred from doing so under any applicable law. The Service is not directed to children under 13, and they may not use it. If you are between 13 and the age of majority where you live, you may use the Service only with the involvement and consent of a parent or legal guardian who agrees to be bound by these Terms on your behalf. By using the Service, you represent that you meet these requirements.
3. The service
Pebble Log is a study tool that lets you log practice questions you answered incorrectly, organize them, attach screenshots, optionally transcribe questions from images, and review your patterns over time. We provide the Service on an "as is" and "as available" basis. We may add, change, suspend, limit, or discontinue any part of the Service — including features, content, and availability — at any time, with or without notice, and we are not liable to you or anyone else for doing so.
4. Your account
You sign in through a third-party identity provider (Google). You are responsible for maintaining the security of the account you use to access the Service and for all activity that occurs under it. You agree to provide accurate information and to keep it current. We may refuse, suspend, or terminate accounts at our discretion. You can delete your account at any time from within the Service; deletion is described in our Privacy Policy.
5. Acceptable use
You agree not to, and not to attempt to or allow others to:
- use the Service in violation of any applicable law or regulation, or in a way that infringes or misappropriates anyone's rights;
- upload or submit content you do not have the right to submit, or that is unlawful, infringing, or harmful;
- interfere with, disrupt, overload, or degrade the Service or the infrastructure it runs on;
- probe, scan, or test the vulnerability of the Service, or breach or circumvent any security or authentication measures;
- access the Service by automated means, scrape it, or use it to build or train a competing product or dataset, except as we expressly permit;
- reverse engineer, decompile, or attempt to derive source code, except to the extent applicable law prohibits this restriction;
- resell, sublicense, or commercially exploit the Service without our written permission;
- misuse the Service to send spam, malware, or other harmful material, or to harass any person.
We may investigate and take any action we consider appropriate for any actual or suspected violation, including removing content and suspending or terminating access, without notice and without liability.
6. Your content and the rights you grant us
"Your Content" means anything you submit to the Service, including logged questions, notes, screenshots and other images, tags, statuses, and other materials.
As between you and us, you retain whatever ownership rights you have in Your Content. You are solely responsible for Your Content and represent and warrant that you have all rights necessary to submit it and to grant the license below, and that Your Content does not violate these Terms or any law or third-party right.
License to us. By submitting Your Content, you grant us a worldwide, non-exclusive, royalty-free, fully paid, perpetual, irrevocable, transferable, and sublicensable license to host, store, copy, reproduce, process, transmit, display, modify, adapt, create derivative works from, analyze, and otherwise use Your Content, in any media and by any means now known or later developed, for any purpose related to operating, providing, securing, improving, developing, and promoting the Service and our current and future products and services — including for analytics, research, the development and training of features, models, and algorithms, and other business and commercial purposes. This license continues even after you stop using the Service or delete Your Content or your account, to the extent copies have been made, retained in backups, incorporated into derived or aggregated data, or are otherwise required for the purposes described in these Terms or our Privacy Policy. You waive, to the extent permitted by law, any moral rights or similar rights in Your Content.
We do not claim ownership of Your Content, and we are under no obligation to store, retain, or make Your Content available to you. We may remove, limit, or refuse any content at our discretion. You are responsible for keeping your own copies of anything important to you.
7. AI and automated features
The Service may offer features that use artificial intelligence and automated processing — for example, transcribing a question from a screenshot. These features may send the relevant content (such as an image you upload) to third-party providers for processing, and their output may be inaccurate, incomplete, or unsuitable for your purposes. AI output is provided for convenience only, without any warranty of accuracy, and you are responsible for reviewing and verifying it before relying on it. We make no commitment that any AI feature will be available, error-free, or fit for any particular purpose.
8. Educational disclaimer; no affiliation
Pebble Log is a study and organization tool. We do not guarantee any particular result, score, score increase, admission outcome, or other benefit from using the Service, and nothing in the Service is a promise of any outcome. Any examples, sample data, or estimates are illustrative only. You are responsible for how you study and for verifying any educational content.
Pebble Log is an independent product and is not affiliated with, endorsed by, sponsored by, or connected to the College Board, Educational Testing Service, or any test maker or content provider. "SAT" and any other trademarks referenced in the Service are the property of their respective owners and are used for identification and descriptive purposes only.
9. Paid plans, billing, and refunds
Parts of the Service may be offered for free, and we may offer paid plans (including subscriptions and one-time purchases). We may change which features are free or paid, introduce new charges, and change prices at any time; for subscriptions, price changes apply to subsequent billing periods.
- Payment processing. Payments are processed by a third-party payment processor (Stripe). By purchasing, you also agree to the processor's terms. We do not receive or store your full payment card details.
- Subscriptions. Subscriptions renew automatically for the applicable period until cancelled. You authorize us and our processor to charge your payment method on each renewal. You can cancel a subscription as described in the Service; cancellation takes effect at the end of the current billing period.
- One-time purchases. One-time purchases grant the access described at the time of purchase and do not renew.
- Refunds. Except where required by applicable law, all payments are non-refundable, and we have no obligation to provide refunds or credits for any reason, including for partially used periods or unused features. Any refund or credit we choose to provide is at our sole discretion and does not entitle you to any future refund or credit.
- Taxes. Prices may exclude taxes; you are responsible for any applicable taxes.
- Non-payment. If a charge fails or is reversed, we may suspend or downgrade your access.
10. Third-party services
The Service relies on and links to third-party services and content (for example, sign-in, payment processing, AI processing, hosting, fonts, and analytics). We do not control and are not responsible for third-party services, their availability, or their terms and practices. Your use of a third-party service is governed by that party's terms and policies, and your dealings with it are solely between you and that party.
11. Our intellectual property
The Service, including its software, design, text, graphics, the Pebble Log name and logo, and all related intellectual property, is owned by us or our licensors and is protected by law. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial study purposes. We reserve all rights not expressly granted. You may not use our name, logo, or branding without our prior written permission.
12. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND ALL CONTENT AND FEATURES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, TIMELY, ACCURATE, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY DATA, INCLUDING YOUR CONTENT, WILL NOT BE LOST, CORRUPTED, OR DISCLOSED. YOU USE THE SERVICE AT YOUR OWN RISK. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL PEBBLE LOG OR ITS OWNERS, OPERATORS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS, WHETHER BASED IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID US FOR THE SERVICE IN THE THREE MONTHS IMMEDIATELY BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $25. THESE LIMITATIONS APPLY EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
14. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Pebble Log and its owners, operators, suppliers, and licensors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, Your Content, your violation of these Terms, or your violation of any law or third-party right.
15. Suspension and termination
We may suspend, restrict, or terminate your access to the Service at any time, for any reason or no reason, with or without notice, including if we believe you have violated these Terms. You may stop using the Service and delete your account at any time. Upon termination, your right to use the Service ends immediately. Sections that by their nature should survive termination — including those on Your Content and the license you grant, disclaimers, limitation of liability, indemnification, and governing law — survive.
16. Changes to the service and these Terms
We may modify these Terms at any time. If we make changes, we will update the "Last updated" date above and may provide additional notice as we consider appropriate. Changes are effective when posted unless stated otherwise. Your continued use of the Service after changes take effect constitutes your acceptance of the updated Terms. If you do not agree, you must stop using the Service.
17. Governing law and disputes
These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws rules. You and we agree that the state and federal courts located in Broward County, Florida will have exclusive jurisdiction and venue over any dispute that is not subject to another agreed dispute-resolution process, and you consent to personal jurisdiction there. To the extent permitted by law, any claim must be brought in your individual capacity and not as part of any class or representative proceeding. Before filing any claim, you agree to first contact us and attempt in good faith to resolve the matter informally.
18. General
These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the Service and supersede any prior agreements. If any provision is found unenforceable, it will be limited or removed to the minimum extent necessary and the rest will remain in effect. Our failure to enforce any provision is not a waiver. You may not assign or transfer these Terms without our consent; we may assign them freely, including in connection with a merger, acquisition, or sale of assets. Headings are for convenience only. Notices to you may be provided in the Service or by other reasonable means.
